1. Acceptance of Terms

By accessing and using Archate ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Use License

Permission is granted to temporarily use Archate for personal or commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose without proper subscription
• Attempt to decompile or reverse engineer any software contained on Archate
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. Credits and Billing

Archate operates on a credit-based system:

• Credits are required to use AI-powered tools and services
• Credits purchased do not expire but monthly subscription credits do not roll over
• All purchases are final and non-refundable unless required by law
• Pricing may change with 30 days notice to existing subscribers
• Subscriptions auto-renew unless cancelled before renewal date

4. User Content and Intellectual Property

You retain all rights to content you create using Archate. By using our service, you grant us:

• The right to process and store your uploads for service delivery
• The right to use anonymized data for improving our AI models
• The right to showcase your work in our gallery (if you choose to share publicly)

You are responsible for ensuring you have the rights to any content you upload to Archate.

5. Prohibited Uses

You may not use Archate to:

• Generate illegal, harmful, or offensive content
• Violate any local, national, or international law
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Distribute malware or engage in any malicious activities
• Resell or redistribute our services without permission

6. Service Modifications

We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

7. Disclaimer

The materials on Archate are provided on an 'as is' basis. Archate makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

8. Limitation of Liability

In no event shall Archate or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Archate, even if Archate or an authorized representative has been notified of the possibility of such damage.

9. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of India, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
